Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Resty mobile application and related digital content (the “Service”). By downloading, installing, or using Resty, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old to use Resty. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. We may suspend or end access if we reasonably believe you do not meet this requirement.
Description of the Service
Resty provides personal sleep tracking, reports and trends, bedtime goals, optional wellness references, Discover content such as sleep tips, breathing sessions, and ambient scenes, virtual coins, theme unlocks, and optional VIP membership benefits. Features may change as we improve the app.
Not medical advice
Resty is a wellness and self-tracking tool only. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services. Sleep stage estimates, risk references, AI insights, and similar outputs are informational and may be approximate. Always consult a qualified health professional for medical questions or emergencies.
Accounts and your responsibilities
- You are responsible for activity on your device and for securing your device, Resty profile, and app store accounts.
- Information you provide, including date of birth for age confirmation, must be accurate to the best of your knowledge.
- Optional sign-in may be available where supported. You must not access another person’s data without permission.
- You may sign out or delete your account profile using in-app controls.
Acceptable use
You agree not to:
- Use Resty in violation of applicable law or the rights of others.
- Reverse engineer, decompile, scrape, or interfere with the Service except where law expressly permits.
- Circumvent purchase, trial, coin, or membership limits, or exploit bugs for unauthorized benefit.
- Introduce malware, harass others, or use the Service for unlawful surveillance or impersonation.
- Overload or disrupt networks or systems connected to the Service.
In-app purchases
Resty may offer optional paid digital content through the Apple App Store. Payment is processed entirely by Apple. Resty does not process card payments directly. Product names, descriptions, and available plans are shown in the app and on the App Store listing at the time of purchase.
1. Virtual goods
Depending on what you buy, you may receive a limited license to use digital items inside Resty only. They are not physical goods. Examples include:
- VIP — premium membership benefits described on the VIP screen for the active period.
- Coins — virtual currency used inside Resty to unlock eligible content or features.
Coins and unlockable content have no real-world cash value and cannot be exchanged, transferred, sold, or redeemed for money outside Resty. We may adjust earn rates, unlock requirements, trials, bundles, or feature availability with reasonable notice in the app where practicable. Promotional grants may be modified or withdrawn as described when offered.
2. Auto-renewing subscriptions
VIP may be offered as an auto-renewable subscription. Plan types may include weekly, monthly, or yearly membership, as shown in the app and store listing at purchase time.
- Subscriptions renew automatically unless you cancel through your Apple account settings before the end of the current billing period, according to App Store rules.
- Apple charges your App Store account; Resty does not charge your card directly.
- To cancel, manage the subscription in your App Store subscription settings. Cancel at least 24 hours before the period ends if required by Apple.
- Use Restore Purchase in Settings when moving to a new device, subject to App Store eligibility and the same Apple ID.
3. Refunds and billing disputes
Refund and billing requests must be submitted to Apple under its policies. We cannot issue App Store refunds directly. If a purchase is refunded or reversed, we may revoke related virtual items, themes, or membership access tied to that transaction.
Intellectual property
Resty, including its software, design, audio, text, graphics, and trademarks, is owned by us or our licensors and protected by intellectual property laws. Except for the limited rights expressly granted in these Terms and the End User License Agreement, no rights are transferred to you.
Third-party services
The Service may rely on third-party platforms such as app stores and sign-in providers. Their terms and privacy practices apply to those interactions. We are not responsible for third-party services we do not control.
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided as is and as available without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.
Limitation of liability
To the maximum extent permitted by law, Resty and its developers, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Service or any in-app purchase, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of amounts you paid us directly for the Service in the twelve months before the claim, which is typically zero because billing is through the App Store, or the minimum amount required by applicable law.
Indemnity
You agree to defend, indemnify, and hold harmless Resty and its developers from claims, damages, losses, and expenses, including reasonable legal fees, arising from your misuse of the Service or violation of these Terms.
Suspension and termination
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or where required by law or store policy. You may stop using Resty at any time by uninstalling the app. Provisions that by nature should survive termination will continue to apply.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the effective date above and, where appropriate, in-app notice. Continued use after changes become effective constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by applicable law where the Service operator is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
